We are providing this message on behalf of our legal counsel. At this time, NAAE cannot recommend that employees pursue an individual MSPB appeal. MSPB appeals for probationary employees are generally limited to cases involving termination due to a protected class status or termination in retaliation for protected activity.
Pursuing an appeal outside of these circumstances is an unknown and may exclude you from alternative legal recourse. Additionally, it may exclude you from any relief the union secures in the future.
Our legal counsel has advised us to wait until the current court cases on the docket play out over the coming days, as they will be critical in determining how we will respond.
