Attention Bargaining Unit Employees! USDA is set to resume random drug testing for employees. If you are: 1) a bargaining unit employee, and 2) asked to undergo a random drug test, your rights as a Bargaining Unit Employee have been broken.
Many years back, NAAE fought for your privacy and was issued a permanent injunction granting all NAAE Bargaining Unit Employees exemption from random drug testing. Please note, you are still required under law to submit to post-accident drug testing and reasonable suspicion drug testing. Again, if you are approached by management or anyone else for random screening, please notify the NAAE Executive Committee immediately. Timely contact is essential as management may argue you are violating an order if you argue or refuse. Let us argue (aggressively) for your rights!
